Rafael has experience in antitrust, telecommunications, real estate and project finance. He has participated in advising several economic agents in merger notification procedures and investigations initiated by the Federal Economic Competition Commission or by the Federal Telecommunications Institute. Among the sectors in which he has participated are energy, technology, fiber, telecommunications, infrastructure, and mining.

Additionally, he has advised on infrastructure projects, including financing and development in both domestic and foreign transactions.

The First Chamber of the Honorable Supreme Court of Justice of the Nation (“SCJN”) recently issued a ruling regarding the scope of civil liability for directors and members of the management bodies of commercial companies in Mexico. In Direct Amparo in Review 7767/2023, the SCJN ruled on the circumstances under which partners or shareholders of a company may bring direct civil actions against directors.
