On June 3, the Ministry of Economy published in the Federal Official Gazette the Agreement that subjects the listed goods to the requirement of automatic export notice.
This Agreement establishes a scheme for obtaining automatic export notice, by virtue of which the exporter of the listed goods should send a request for each export customs declaration (pedimento) to an email address of the Ministry of Economy, and provide the General Direction of Commercial Facilitation of Foreign Trade with the information in Excel format that was published on the website of the National Foreign Trade Information Service (SNICE). This Excel format has several fields divided into 3 sections: General Data, Automatic Export Notice Data and Subheading 72 and 73. In this same format several requests can be entered since for each row (pedimento) a notice will be issued.
This request should be resolved within a maximum of 10 working days.
In the aforementioned Agreement it was stated that the entry into force would be the day after its publication in the Official Gazette; however, an extension until July 7 for the filing of the notice was later published on SNICE’s website, stating that the notice request cannot be filed before June 30, which automatically makes it impossible to obtain it within the 10 days before the obligation begins.
Among the goods that are subject to this new notice are tequila, malt beer, catalytic converters, memory units, fiber optic cables, harnesses and data processing machines, most of which are used as components in the automotive industry, among others.
This measure, in addition to representing an additional administrative burden for exporting companies, will delay the supply chain, may generate operational risks and will affect the operation of the consolidated pedimento scheme.
