On October 7th, 2025, Mexico’s President sent to the Senate her proposal of candidates for commissioners who will make up the Plenum of the National Antitrust Commission (the "CNA"). Ratification by the Senate must occur before November 5, 2025, however it is expected to occur at any time. Within 10 days after such ratification, the President will designate the person who will serve as president of the CNA. Once the president of the CNA is appointed, the Plenum of the CNA will be integrated and the CNA will take office, thus replacing the Federal Economic Competition Commission ("COFECE") and the Federal Telecommunications Institute ("IFT"), the latter in the exercise of its powers in matters of competition, preponderance and cross-participation in the telecommunications and broadcasting sectors.
The foregoing constitutes a further step towards the implementation of the constitutional reform published on December 20, 2024, in the Official Gazette of the Federation (“DOF”), as well as the reform to the Federal Economic Competition Law ("FECL") published in the DOF on July 16, 2025 (the "Amendment to the FECL").
What are the implications?
- All legal acts issued by COFECE and the IFT prior to the integration of the CNA will continue to have effects.
- The CNA will replace the CNA and the IFT in all their attributions, obligations and powers with respect to any ongoing procedure, regardless of its nature.
- The day after the integration of the Plenum of the CNA, the investigations in process by the Investigating Authorities of COFECE and the IFT, which were suspended as of the entry into force of the Amendment to the FECL, will be resumed.
- All legal instruments, agreements, inter-institutional agreements, contracts or acts entered into by COFECE shall be understood as in force and shall be binding on the CNA, without prejudice to the fact that they may be ratified, modified or terminated subsequently.
- Within a period of no more than 180 calendar days from the integration of the CNA, its Organic Statute and the regulations to FECL must be issued. Until these provisions are issued, the current regulatory framework will remain in force, in everything that does not oppose the Amendment of the FECL.
New Commissioners of the Plenum of the CNA
Once ratified by the Senate, the Commissioners who will constitute the Plenum of the CNA are the following:
- Andrea Marván Saltiel, appointed for the period from 2025 to 2028. She currently serves as Chairwoman of COFECE and President of the International Competition Network and the Network of Competition Authorities of Latin America.
- Ana María Reséndiz Mora, appointed for the period from 2025 to 2029. She currently serves as a Commissioner of COFECE.
- Óscar Alejandro Gómez Romero, appointed for the period from 2025 to 2030. He served as Executive Coordinator of the National Commission for Regulatory Improvement and General Director of Competitiveness and Economic Competition of the Secretariat of Economy.
- Ricardo Salgado Perrillat, appointed for the period from 2025 to 2031. He served as Head of the Legal Affairs Unit of the Federal Court of Administrative Justice and previously held various positions, including being Head of the Investigative Authority of the IFT, the authority in charge of exercising investigative powers in matters of economic competition in the telecommunications and broadcasting sectors.
- Haydee Soledad Aragón Martínez, appointed for the period from 2025 to 2032. She served as Secretary of Labor and Employment Promotion in Mexico City.
Appointment of Chairperson of the CNA Plenum
Andrea Marván Saltiel has been nominated by Mexico’s President to serve as Chairwoman of the CNA for a three-year term. This appointment is subject to Senate’s ratification, which is expected to occur at any time after the ratification of commissioners.
