On April 13, 2026, the "Resolution Whereby the Plenary of the Telecommunications Regulatory Commission Approves the Amendment to the 2026 Annual Frequency Band Use and Exploitation Program" was published in the Official Gazette of the Federation (Diario Oficial de la Federación).
This Program was originally issued on January 6, 2026, and allows any interested party to request the inclusion of additional or different frequencies and geographic coverage areas within 30 business days of its publication. The Telecommunications Regulatory Commission (the "Commission") is then required to issue a decision on such requests within no more than 30 business days. This amendment is the result of the Commission's review of inclusion requests received between July 1, 2025, and February 18, 2026. The full text of the amendment is attached for your reference.
The key highlights are set out below.
Broadcasting. The amendment adds new frequencies for audio broadcasting services across Amplitude Modulation (5 frequencies for public and social use), Frequency Modulation (27 frequencies: 11 for commercial use, 11 for public use, and 5 for social use), and Digital Terrestrial Television (50 channels across various use categories). With these additions, the 2026 Program now covers a total of 134 frequencies and channels for the public broadcasting service.
In addition, pursuant to Article 69 of the Federal Telecommunications and Broadcasting Law, the Commission has reserved FM-band frequencies for community, indigenous, and Afro-Mexican social-use audio broadcasting stations in 96 localities nationwide. This reservation covers up to 10% (2 MHz) of the 88–108 MHz FM band, as well as the 1605–1705 kHz AM band.
Telecommunications. The 2026 Program designates various frequency bands for commercial, private, and public use in the telecommunications sector.
It is important to note that the commercial-use frequencies and bands included in this amendment may be considered for auction proceedings in the short and medium term — not necessarily during 2026 — subject to the Commission's planning and available resources. Public- and social-use broadcasting concession applications must be filed within the specific deadlines established in the Program, whereas telecommunications concession applications for public, social, and private use are not subject to a fixed deadline and may be filed on any business day.
Finally, the Commission has launched a technology platform for the submission of inclusion requests, available 24 hours a day, year-round.
