Update of the Unit of Measurement and Concentration Amounts

Conversation on Reforms to the Federal Economic Competition Act

On January 9th, 2026, the National Institute of Statistics and Geography published in the Federal Official Gazette an update of the Mexican Unit of Measurement and Update (“UMA”)1:

2 Allamounts expressed in U.S. dollars were calculated using the following exchangerate: MXN$18.00 = US$1.00.

The values reflect a 3.7% increase over the prior year and will take effect on February 1, 2026.

This update modifies the merger control thresholds provided in Article 86 of the Federal Economic Competition Law as follows:

Likewise, it is important to consider that the fines that can be imposed by the National Antitrust Commission are fixed in UMAs, so these will also be increased in 3.7%.

Today, December 19, 2025, official communication number CNA-068-2025 was published in the Official Gazette of the Federation, which enters into force on this same day and establishes the fees applicable to the services of the National Antitrust Commission (the “Commission”), in particular for the receipt, study, and processing of merger notifications.
Following recent regulatory developments in telecommunications and broadcasting, on October 7, 2025, the President sent to the Senate her proposal for candidates for commissioners to be part of the Plenum of the Telecommunications Regulatory Commission ("CRT"). On October 14, the Senate ratified the appointment of the commissioners proposed by the President and on October 16, 2025, the President appointed Norma Solano Rodríguez as Chairwoman of the CRT. With this, as of October 17, 2025, the constitutional reform on organic simplification published on December 20, 2024 in the Official Gazette of the Federation (“DOF”) came into force, by which the Federal Telecommunications Institute ("IFT") is extinguished, and the CRT starts operations as the sole authority in telecommunications and broadcasting.
On October 7th, 2025, Mexico’s President sent to the Senate her proposal of candidates for commissioners who will make up the Plenum of the National Antitrust Commission (the "CNA"). Ratification by the Senate must occur before November 5, 2025, however it is expected to occur at any time. Within 10 days after such ratification, the President will designate the person who will serve as president of the CNA. Once the president of the CNA is appointed, the Plenum of the CNA will be integrated and the CNA will take office, thus replacing the Federal Economic Competition Commission ("COFECE") and the Federal Telecommunications Institute ("IFT"), the latter in the exercise of its powers in matters of competition, preponderance and cross-participation in the telecommunications and broadcasting sectors.
