President appoints Andrea Marván as Chairwoman of the National Antitrust Commission (CNA) and CNA starts operating

Following our Client Alert published on October 8th (available here), on October 16, 2025, the President appointed Andrea Marván Saltiel as Chairwoman of the National Antitrust Commission (the "CNA").  As a result, as of October 17:

  1. The constitutional reform on organic simplification, published on December 20, 2024, in the Official Gazette of the Federation (“DOF”) will enter into force, through which the Federal Economic Competition Commission ("COFECE") and the Federal Telecommunications Institute ("IFT") are officially extinguished, and the CNA will start operating as the sole antitrust authority.
  2. The  investigation procedures conducted by the Investigative Authorities of COFECE and IFT, are resumed. Pursuant to a notice issued on October 21 by the CNA, due to the transition, the statutory deadlines were suspended from October 17 to 21, 2025, and therefore the computation of deadlines shall commence as of today.
  3. The 180 calendar days period for the Organic Statute of the CNA and the Regulations of the Federal Economic Competition Law to be issued will start. Until these legal framework is issued and published, the Organic Statute, as well as Regulatory Provisions, Criteria, Guidelines and other regulations issued by COFECE, will remain in force, in everything that does not oppose the Decree amending, adding and repealing various provisions of the Federal Economic Competition Law and the Federal Law on Parastatal Entities, published in the DOF on July 16th, 2025.

Mexico is entering a decisive stage in the evolution of its antitrust policy. With the recent reform to the Federal Economic Competition Law, the Federal Economic Competition Commission (COFECE) will give way to the National Antitrust Commission (CNA), a new institution that will assume an even more central role in market regulation.
On October 7th, 2025, Mexico’s President sent to the Senate her proposal of candidates for commissioners who will make up the Plenum of the National Antitrust Commission (the "CNA"). Ratification by the Senate must occur before November 5, 2025, however it is expected to occur at any time. Within 10 days after such ratification, the President will designate the person who will serve as president of the CNA. Once the president of the CNA is appointed, the Plenum of the CNA will be integrated and the CNA will take office, thus replacing the Federal Economic Competition Commission ("COFECE") and the Federal Telecommunications Institute ("IFT"), the latter in the exercise of its powers in matters of competition, preponderance and cross-participation in the telecommunications and broadcasting sectors.
